RESUMEN En este trabajo intento determinar, a partir de textos escogidos de todas las épocas de la producción teórica de Carl Schmitt, de qué manera este autor entiende la comprensión jurídica y de qué manera este modo de comprensión tiene alcances generales para la comprensión práctica. En la medida en que el derecho tematiza las condiciones y los polos de la comprensión, la posición del jurista se distancia tanto de la inclinación hacia el polo ideal, que Schmitt identifica con la (...) racionalidad tecnológica, cuanto de la inclinación hacia el polo real, que Schmitt liga a ciertas formas del romanticismo y el pensamiento teológico. RESUMO Neste artigo, tento determinar, a partir de textos selecionados de todos os períodos da produção teórica de Carl Schmitt, como esse autor entende a compreensão jurídica e como esse modo de compreensão tem alcance geral para a compreensão prática. The article approaches Salomon Maimon’s reinterpretation of the notions of the thing in itself and the given within the framework of criticism. For Maimon they do not refer to a transcendence that is directly unattainable by knowledge. In this attempt, he tries to explain the given on the basis of the action of constitutive understanding. With this, he triggers the passage from transcendental Kantian philosophy to the idealism of Fichte. Nonetheless, his position faces the subsequent problem of explaining how the (...) constitution of the given from understanding (infinite) can become compatible with the criticism it takes on. On affirming that an uncognoscible item is the basis of knowledge, namely, infinite understanding, he set aside the explanation of knowledge in terms of what is revealed in it and in doing so would be resorting to external uncognoscible conditions. De acordo com as interpretações mais conhecidas (por exemplo, Hofmann, Strauss, Löwith ou Kuhn), o pensamento jurídico e político de Carl Schmitt mantém distância de Aristóteles. Este artigo tem a intenção de mostrar que a concepção de direito de Schmitt, apesar de ser desenvolvida em um contexto diferente, contém semelhanças significativas com o entendimento de direito em Aristóteles. Para mostrar essa proximidade, considera-se especialmente a noção de totalidade presente no conceito aristotélico de polis, que implica que a unidade política é (...) o principal modo de se realizar o direito. According to mostly known interpretations (e.g.: Hofman, Strauss, Löwith or Kuhn), the legal and political thought of Carl Schmitt keeps distance from Aristotle's. This article intends to show that Schmitt's concept of law, despite developed in a different context, holds significant likelihood with Aristotle's comprehension of law. With the Purpose of building this proximity, the notion of entirety present in the Aristotelic concept of polis implies that political unit is the main way to accomplish law. (shrink)

En este artículo se analiza el comentario de Maimon al intento kantiano de vincular sensibilidad y entendimiento. En la Crítica de la razón pura, Kant distingue dos facultades de conocimiento, que deben ser unidas para que el conocimiento objetivo sea posible. Maimon cuestiona que la vinculación sea realizable. Luego de exponer el punto de partida kantiano, se analizan los argumentos maimonianos, planteando dificultades sistemáticas que afectarían al intento de vinculación kantiano.

Olympic combat sports are unconventional physical activity strategies to train middle-aged and older people with and without health problems. This systematic review aimed to assess the available body of published peer-reviewed articles related to the effects of Olympic combat sports interventions on health-related quality of life in adults aged 45 and older. The search was carried out in five generic databases until July 2021 and the protocol was registered in PROSPERO. The PRISMA guidelines were followed and the Downs and Black (...) checklist was used to assessed the methodological quality of the studies. After reviewing 1,151 records, only seven studies met the inclusion criteria, adding 212 participants with a mean age of 63.7 years. Six studies provided data to calculate the effect size in the Olympic combat sports groups. Three studies reported beneficial changes with a small ES for the total score of the health-related quality of life. Two studies reported a beneficial change with a small ES and strong ES for physical health. One study reported improvements with a small ES for emotional and functional well-being. In conclusion, interventions based on Olympic combat sports produce beneficial effects with a small and moderate ES on health-related quality of life in male and female aged 45 and older who are healthy participants, participants with Parkinson's disease, and participants with breast cancer.Systematic Review Registration:https://www.crd.york.ac.uk/prospero/, PROSPERO: CRD42021244161. El presente artículo indaga si ¿es el sujeto un ser autónomo en la deliberación política o sonlos pensamientos, las posturas y las formas de la organización política mediadas por las distintas herramientas comunicacionales a las que se ve expuesto quienes lo determinan? Así, analiza larelación que existe entre mass media y política, con la capacidad deliberativa del individuo altomar decisiones en el contexto político, a partir de Chomsky y Han. La metodología es cualitativa con diseño documental, el instrumento son fichas (...) bibliográficas aplicadas a fuentes primarias y secundarias. Se usan bases de datos con el algoritmo: “Neoliberalismo, psicopolítica, big data, medios de comunicación de masas y democracia”. Se analizan 13 libros y 20 artículos. Se identifican las nuevas formas y herramientas de organización política y la relación entre política y medios de comunicación. Se concluye que: 1) el neoliberalismo direcciona la idea de libre mercado hacia el individuo mismo, 2) es necesaria una ciudadanía crítica que tenga un rol más activo en lademocracia, 3) se identifica a la psicopolítica como una nueva forma de organización política, 4) lanueva herramienta de la política es el big data, 5) se evidencia que la relación entre política y massmedia está vinculada con los grupos de poder y 6) la emocionalización de la comunicación políticadisminuye la autonomía individual. Unfounded—conspiracy and health—beliefs about COVID-19 have accompanied the pandemic worldwide. Here, we examined cross-nationally the structure and correlates of these beliefs with an 8-item scale, using a multigroup confirmatory factor analysis. We obtained a two-factor model of unfounded (conspiracy and health) beliefs with good internal structure (average CFI = 0.98, RMSEA = 0.05, SRMR = 0.04), but a high correlation between the two factors (average latent factor correlation = 0.57). This model was replicable across 50 countries (total N = 13,579), (...) as evidenced by metric invariance between countries (CFI = 0.96, RMSEA = 0.06, SRMS = 0.07) as well as scalar invariance across genders (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03) and educational levels (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03). Also, lower levels of education, more fear of COVID-19, and more cynicism were weakly associated with stronger conspiracy and health beliefs. The study contributes to knowledge about the structure of unfounded beliefs, and reveals the potential relevance of affective (i.e., fear of COVID-19) and cognitive (i.e., cynicism) factors along with demographics, in endorsing such beliefs. In summary, we obtained cross-cultural evidence for the distinctiveness of unfounded conspiracy and health beliefs about COVID-19 in terms of their structure and correlates. (shrink)

In this note, the problem of tracking random references and rejecting random perturbations in a quadrotor, both generated by an auxiliary system named exosystem, is solved by extending the deterministic tracking problem to the area of stochastic processes. Besides, it is considered that only a part of the state vector of the quadrotor is available through measurements. As a consequence, the state vector of the plant must be estimated in order to close the control loop. On this basis, a controller (...) to track random references and to reject random perturbations is developed by combining a Kalman filter to estimate the references and perturbations of an exosystem and an observer to estimate the states of a quadrotor. Besides, to obtain a more practical controller, the analysis is carried out in discrete time. Numerical simulations are used in a quadrotor to confirm the validity and effectiveness of the proposed control. (shrink)

In what follows, I will provide some elements for constructing Mariátegui’s plural spatiotemporal conception of history. I will do so by focusing on the two books he published in his lifetime: The contemporary scene and Seven Interpretive Essays on Peruvian Reality. In a footnote in the Seven Essays, the reader encounters a concept that opens up the problem of plural temporality in Latin American Marxism: relativismo histórico (historical relativism). This will be the keystone concept upon which certain fragments of Mariátegui’s (...) writings will be put together to construct the concept of plural temporality. This involves taking a detour through what Mariátegui understood by relativismo (relativism). In that detour, we find that Mariátegui’s use of relativismo consists in translating and assimilating the insights of one of the pillars of contemporary physics: Einstein’s theory of relativity. For Mariátegui, the relativistic theory of spacetime undermined the old “absolutes” of the positivist unilinear philosophy of history. I then argue that Mariátegui, through his friend and comrade Hugo Pesce, assimilates and translates the “revolutionary” theory of spacetime as a weapon against the unilinear philosophy of history and as a resource to construct a concept of plural spatiotemporal concept of history. Re-situating Mariátegui’s work along this axis puts some pressure on certain Bergsonian and Sorelian readings that overemphasize the importance of Myth and Humanity as a “metaphysical animal” and thereby tend to underemphasize or outright suppress his creative assimilation and translation of the sciences of his time. Brecht’s Life of Galileo provides elements for elaborating what I call “a theory of the encounter of practices”. The concept of the encounter pushes back against teleological theories that predestine modern science to operate as an instrument of domination. I argue that Life of Galileo stages the missed encounters in modernity between science, politics, and art at the same time as it foregrounds the emancipatory power of science. I trace the encounter of practices from the play’s opening scenes – highlighting (...) what I call Galileo’s “double life”. Then, I turn to the most important scene of the play, Scene 10, in which political and artistic practices repurpose Galileo’s novel inventions for their emancipatory desires. In the virtual potentialities of this encounter, that is, despite the missed encounter between Galileo and “the people”, Brecht’s Life of Galileo continues to be fruitful for theorizing the emancipatory power of science. The “boomerang thesis” enjoys widespread currency in contemporary scholarship: that the means and ends of colonial domination would “spin back” to the metropole is an idea with intuitive grip. This article extrapolates the depth of meaning this metaphor contains, as well as what it conceals. It first considers the “boomerang” as it appears in Aimé Césaire’s Discourse on Colonialism, a poetic work that captures the moral and experiential return-effects of imperial violence. Turning to Hannah Arendt’s The Origins of Totalitarianism—the only (...) articulation of the thesis that uses the word “boomerang”—the article disaggregates the teleological, ideological, and institutional elements that spun back from European colonies in the imperial era. Finally, it traces the development of the thesis in Michel Foucault’s “Society Must Be Defended,” where it is transformed into a more general explanatory mechanism. Each theorist indicates how distance operates to transform dubious, even hateful ideas into acceptable practices. (shrink)

En las últimas décadas se ha desarrollado un (...) intenso debate que contrapone a los defensores de un modelo liberal de sociedad y a los que apuestan por un modelo comunitario. Bajo el manto liberal se engloban todas aquellas teorías políticas cuyo objetivo es buscar procedimientos, universalmente compartidos, de agregación de los intereses individuales. Por su parte, en el bando comunitarista, nos encontramos aquellos planteamientos -cuyo denominador común es una crítica a toda visión puramente procedimentalista de la filosofía pública-, que consideran que sólo se posee una comunidad política cuando se recurre a un patrimonio común de contenidos, valores y tradiciones, en el que todos los miembros de la comunidad se sienten radicados. En esta obra se presenta un análisis detallado de los protagonistas y de las etapas de este debate, proponiendo como conclusión un modelo de sociedad que pretende dar respuesta tanto a las instancias radicadas en el modelo procedimental como a las presentes en el modelo comunitario. Recently, it has been proposed to understand a logic as containing not only a validity canon for inferences but also a validity canon for metainferences of any finite level. Then, it has been shown that it is possible to construct infinite hierarchies of "increasingly classical" logics—that is, logics that are classical at the level of inferences and of increasingly higher metainferences—all of which admit a transparent truth predicate. In this paper, we extend this line of investigation by taking a somehow (...) different route. We explore logics that are different from classical logic at the level of inferences, but recover some important aspects of classical logic at every metainferential level. We dub such systems meta-classical non-classical logics. We argue that the systems presented deserve to be regarded as logics in their own right and, moreover, are potentially useful for the non-classical logician. (shrink)

_The Power of Religion in the Public Sphere_, co-edited by Eduardo Mendieta and Jonathan VanAntwerpen, represents a rare opportunity to experience a diverse group of preeminent philosophers confronting one pervasive contemporary concern: what role does, or should, religion play in our public lives? Reflecting on her recent work concerning state violence in Israel-Palestine, Judith Butler explores the potential of religious perspectives for renewing cultural and political criticism, while Jürgen Habermas, best known for his seminal conception of the public sphere, (...) thinks through the ambiguous legacy of the concept of "the political" in contemporary theory. Charles Taylor argues for a radical redefinition of secularism, and Cornel West defends civil disobedience and emancipatory theology. Eduardo Mendieta and Jonathan VanAntwerpen detail the immense contribution of these philosophers to contemporary social and political theory, and an afterword by Craig Calhoun places these attempts to reconceive the significance of both religion and the secular in the context of contemporary national and international politics. The key concept in Business Ethics has changed from ‘corporate social responsibility’ to ‘integrated risk‐management’. This change, first wrought by American laws, has been extended to other countries through globalization. The most important laws concern corruption, anti‐trust, consumer safety, environmental protection and insider‐trading. The ‘Federal Corporate Sentencing Guidelines’ have particularly been helpful in identifying and valuing business risks. The author proposes a ‘next‐generation’ Business Ethics integrating personal, professional and organizational ethics in the context of an institutionalized, country‐sensitive ‘corporate culture’.

The aim of this research is to develop and validate a measurement scale for consumer’s perceptions of corporate social responsibility using the three-dimensional social, environmental and economic conceptual approach as a theoretical basis. Based on the stages of measurement scale creation and validation suggested by DeVellis and supported by Churchill Jr.’s :64–73, 1979) suggestions, five different empirical studies are developed expressly and applied to consumers of tourist services. This research involves 1147 real tourists from 24 countries in two different cultural (...) and geographical contexts. A three-dimensional 18-item scale is proposed for measuring consumer perceptions of corporate social, environmental and economic responsibilities. This paper introduces ‘Virtue and Virtuousness: When will the twain ever meet?’ a special edition of Business Ethics: A European Review. The Call for Papers invited contributions that could inform the relationship between organisational virtuousness, as conceptualised by positive organisation studies, and the classical conception of virtues pertaining to individual women and men. While the resources of particular virtue traditions – Aristotelian, Catholic, Confucian, and the like – could inform their own debates as to whether virtue extends beyond individuals, the (...) debate between virtue traditions and positive organisation studies has a different dimension. The question is whether the claims of positive social sciences as such are compatible with those of any virtue tradition. We argue that positive social science and virtue traditions are indeed rivals such that adherence to the claims of the one precludes adherence to the other. Resolution to such conflicts requires that one tradition is able to resolve questions that exhaust the resources of the other. This paper suggests that at least one area of incoherence in the findings of positive social sciences can be resolved by virtue traditions, and introduces the remaining papers in the special edition. Background:Decision-making and assessment in emergency situations are complex and result many times in ethical conflicts between different healthcare professionals.Aim:To analyse and describe situations that can generate ethical conflict among nurses working in emergency situations.Methods:Qualitative analysis. A total of 16 emergency nurses took part in interviews and a focus group.Ethical considerations:Organisational approval by the University Hospital, and informed consent and confidentiality were ensured before conducting the research.Result/conclusion:Two categories emerged: one in ‘ethical issues’ and one in ‘emotions and feelings in caring’. The (...) four ethical subcategories are presented: Autonomy, the first sub category: first, the nurse’s ability to practise care on an emergency ward and, second, to support the patient and/or relatives in terms of care and medical treatment. The conflicts arise when the nurse ends up in the middle between the patient and the physician responsible for the diagnosis and treatment from a nature scientific perspective. Reification of injured body: patient was often reified and fragmented, becoming just a leg or arm. Different factors contributed in this perspective. Pain: pain relief was often inadequate but more effectively treated in the emergency medical services than at the emergency department. The nurses highlighted the phenomenon of suffering because they felt that pain was only an object, forgetting the patients’ care need, like separating mind from body. Death: the nurses felt that the emergency services are only prepared to save lives and not to take care of the needs of patients with ‘end-of-life’ care. Another issue was the lack of ethical guidelines during a cardiac arrest. Resuscitation often continues without asking about the patient’s ‘previous wishes’ in terms of resuscitation or not. In these situations, the nurses describe an ethical conflict with the physician in performing their role as the patient’s advocate. The nurses express feelings of distress, suffering, anger and helplessness. (shrink)

O objetivo do artigo é apresentar alguns aspectos das reflexões de Franklin Leopoldo e Silva sobre a presença da filosofia na educação básica no Brasil. Nesse intento, também analisaremos algumas considerações suas sobre o ideal de formação no ensino superior.

ABSTRACT:This article proposes a theory of the firm based on the common good. It clarifies the meaning of the term “common good” tracing its historical development. Next, an analogous sense applicable to the firm is derived from its original context in political theory. Put simply, the common good of the firm is the production of goods and services needed for flourishing, in which different members participate through work. This is linked to the political common good through subsidiarity. Lastly, implications and (...) challenges arising from the positing of work as the common good of the firm are explored. (shrink)

In this paper we discuss the extent to which the very existence of substructural logics puts the Tarskian conception of logical systems in jeopardy. In order to do this, we highlight the importance of the presence of different levels of entailment in a given logic, looking not only at inferences between collections of formulae but also at inferences between collections of inferences—and more. We discuss appropriate refinements or modifications of the usual Tarskian identity criterion for logical systems, and propose an (...) alternative of our own. After that, we consider a number of objections to our account and evaluate a substantially different approach to the same problem. (shrink)

In recent years, business ethics and economic scholars have been paying greater attention to the development of commons organizing. The latter refers to the processes by which communities of people work in common in the pursuit of the common good. In turn, this promotes commons organizational designs based on collective forms of common goods production, distribution, management and ownership. In this paper, we build on two main literature streams: the ethical approach based on the theory of the common good of (...) the firm in virtue ethics and the economic approach based on the theory of institutions for collective action developed by Ostrom’s research on common-pool resources to avert the tragedy of the commons. The latter expands to include the novel concepts of new commons, “commoning” and polycentric governance. Drawing on the analysis of what is new in these forms of organizing, we propose a comprehensive model, highlighting the integration of two sets of organizing principles—common good and collective action – and five problem-solving processes to explain the main dimensions of commons organizing. We contribute to business ethics literature by exploring the convergence between the ethical and economic approaches in the development of a commons organizing view. (shrink)

Who Comes After the Subject offers the most comprehensive overview to date of contemporary French thinking on the question of the "subject." Nineteen philosophers and critics offer diverse perspectives on the subject as it has manifested itself in our modern discourses: the subject of philosophy, of the State, of history, of psychoanalysis. Each contribution asks What has become of the subject? or What has the subject become? in the wake of its critiques and deconstructions .

When discussing Logical Pluralism several critics argue that such an open-minded position is untenable. The key to this conclusion is that, given a number of widely accepted assumptions, the pluralist view collapses into Logical Monism. In this paper we show that the arguments usually employed to arrive at this conclusion do not work. The main reason for this is the existence of certain substructural logics which have the same set of valid inferences as Classical Logic—although they are, in a clear (...) sense, non-identical to it. We argue that this phenomenon can be generalized, given the existence of logics which coincide with Classical Logic regarding a number of metainferential levels—although they are, again, clearly different systems. We claim this highlights the need to arrive at a more refined version of the Collapse Argument, which we discuss at the end of the paper. (shrink)

Many authors have considered that the notions of paraconsistency and dialetheism are intrinsically connected, in many cases, to the extent of confusing both phenomena. However, paraconsistency is a formal feature of some logics that consists in invalidating the rule of explosion, whereas dialetheism is a semantical/ontological position consisting in accepting true contradictions. In this paper, we argue against this connection and show that it is perfectly possible to adopt a paraconsistent logic and reject dialetheism, and, moreover, that there are examples (...) of non-paraconsistent logics that can be interpreted in a dialetheic way. This article introduces the concept of ‘strategic identity’ as a bridge between the indigenous peoples’ struggle for self-determination and their search for solidarity in the context of globalization, with a focus on the Lumads, or indigenous peoples in southern Philippines. The paper begins with an encounter with a global actor affecting a local community. We realize the impact of powerful, well-networked forces that challenge even the operation of the state. Without trivializing the threats associated with this model of globalization, we (...) also insist that a realistic and hopeful approach may emerge if we acknowledge the many ‘selves’ in the indigenous peoples’ self-determination. At the heart of this proposal is a matrix that unpacks the complex ways that local, national, sectoral, and global actors can engage in conflict or solidarity with these strategic identity assertions. Solidarity work, then, becomes diversified and strategized in response to the evolving multiple indigenous identities that modernity paradoxically both endangers and engenders. (shrink)
